In the state of Kentucky your Weichert associate will act as your Buyer Agent, per the state law. These duties include negotiation for the client's best interest, informing the client of all known material facts and to maintain confidential information. In Kentucky, the agent can legally be the agent for both the Buyer and the Seller in a transaction. But only with the knowledge and consent of all parties. The agent shall be deemed a Dual-Limited Agent. In this situation, the agent has limited fiduciary duties of utmost care, integrity, honesty and loyalty in dealings with both the Buyer and Seller. The agent still has the obligation to disclose all facts known to the agent materially affecting the property that are not known within the diligent attention and observation of the parties. DISCLOSURE

Kentucky law requires Sellers to disclose certain information with regards to their home. The regulation is designed to protect both Buyers and Sellers. The disclosure form used in our market area includes information with regards to the ages of the mechanicals and the roof system, defects with regards to the structure, any past or present defects with the plumbing, electrical or mechanical systems including the septic system and drainage issues. Any impending lawsuits, title defects, natural disaster events, home owner association information and boundary issues are also included on the form. It is not a substitute for inspections, and is not deemed to be warranted.
